Abstract

This paper examines the role of whistleblowers in exposing corruption and promoting transparency in India. It highlights how individuals with insider knowledge often play a crucial role in uncovering unethical and illegal practices, despite facing serious risks such as harassment, retaliation, and threats to their safety. The study traces the development of whistleblower protection in India culminating in the enactment of the Whistle Blowers Protection Act, 2014 and analyses related legal frameworks, including the Companies Act, 2013, SEBI regulations, the Prevention of Corruption Act, 1988, and the Lokpal and Lokayuktas Act, 2013.The paper finds that irrespective of the existence of legal safeguards, significant challenges remain in implementation. Delays in enforcement, limited protection mechanisms, procedural shortcomings, and the exclusion of private-sector whistleblowers continue to undermine the effectiveness of the framework. Through an examination of notable cases such as those of Satyendra Dubey and Dr. Anand Rai, the study illustrates the practical difficulties faced by whistleblowers in India. The paper concludes that stronger legal protections, effective enforcement mechanisms, independent oversight bodies, and comprehensive support systems are essential to encourage whistleblowing and strengthen anti-corruption efforts in the country.
