Abstract

The Collegium System in India, responsible for the appointment and transfer of judges in the higher judiciary, has been a subject of extensive debate. While it has faced criticism for its perceived lack of transparency and accountability, this research paper argues that the Collegium System, when properly implemented, serves as a balanced framework that ensures judicial independence, upholds the integrity of the judiciary, and fosters a balanced system of justice. This paper examines the evolution, functioning, criticisms, and the inherent strengths of the Collegium System, supported by relevant case laws, and proposes reforms to address its limitations while preserving its core principles.
